This Service Agreement (“Agreement”) is concluded betweenSmart Soft and Services LLC(TIN: 3105324471), the provider of theSoft10platform (“Service Provider”), and the individual or legal entity (“Customer”) using the services. The Agreement enters into force upon Customer registration and governs legal usage of the services.
1. Purpose of the Agreement
This Agreement defines the rules, obligations, and responsibilities of the Customer when using the Soft10 platform.
2. Description of Services
Soft10 is a SaaS platform providing automated WhatsApp messaging and customer communication tools. Key services include:
Automated and scheduled WhatsApp messaging
API integration for system-triggered notifications
Customer segmentation and bulk messaging
Auto-reply and AI chatbot setup
Extracting contacts from WhatsApp Web (via Chrome extension)
Real-time event tracking via Webhook
Gender-based and scheduled campaign messages
3. Service Usage Rules
The Customer agrees to:
Use services only for legal and ethical purposes
Avoid spam, threats, offensive content, or unsolicited advertising
Comply with WhatsApp and Soft10 usage policies
Not resell services to third parties
4. Payments and Fees
The Customer agrees to make monthly or yearly payments based on the selected plan, via:
Bank transfer (for corporate users)
Online POS (credit/debit card)
Fee changes will be notified 10 days in advance.
5. Data Privacy and Security
Customer data is stored securely on local servers and used solely for service provision. Soft10 complies with Azerbaijani laws regarding data protection.
6. Limitation of Liability
Soft10 is not liable for:
Message delivery failures
WhatsApp number blocks
Loss of revenue or indirect damages
7. Prohibited Use
Soft10 services may not be used for:
Sending ads to numbers without prior communication
Violating WhatsApp terms
Technical disruptions
Misusing multiple accounts
8. Term and Termination
The Agreement is valid from the date of registration. Soft10 may suspend service if terms are violated. The customer must notify Soft10 in writing for termination.
9. Dispute Resolution
Disputes are resolved under Azerbaijani law, first through negotiation, then through court if necessary.
10. Final Provisions
Changes to the Agreement require written consent. Services must be used as per the official Soft10 packages.
